TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the contractual relationship between Marrakech Local Tours and its customers. Any booking implies unreserved acceptance of these conditions.

ARTICLE 1 - DEFINITIONS
- "Provider": Marrakech Local Tours
- "Customer": Any person making a booking
- "Tour": Guided visit or excursion offered by the Provider
- "Booking": Firm commitment by the Customer for a Tour

ARTICLE 2 - PURPOSE
These Terms and Conditions define the conditions of sale for tours and excursions offered by Marrakech Local Tours in Marrakech and surrounding areas.

ARTICLE 3 - BOOKING
3.1. Bookings can be made:
- Online via our website
- By WhatsApp at +212 6 65 96 90 49

3.2. The booking is confirmed after:
- Receipt of full payment or requested deposit
- Sending of a confirmation email by the Provider

3.3. Required information:
- First and last name of each participant
- Preferred tour date
- Number of participants
- Contact details (phone and email)
- Hotel name and address (for meeting point)

ARTICLE 4 - PRICES AND PAYMENT
4.1. Prices are indicated in Euros (€) and include:
- Services of a professional local guide
- Transportation if mentioned in the tour description
- Site entrance fees if mentioned in the description

4.2. Prices do not include:
- Meals (unless otherwise stated)
- Personal beverages
- Tips (at your discretion)
- Personal expenses

4.3. Accepted payment methods:
- Credit card (via PayPal)
- Cash (on site, on the day of the tour)

4.4. Group pricing:
- Prices vary according to group size
- Degressive rates are applied automatically
- For groups of 10 or more, contact us for a personalized quote

ARTICLE 5 - CANCELLATION BY CUSTOMER
5.1. Cancellation conditions:
- More than 48h before the tour: Full refund
- Between 24h and 48h before: 50% refund
- Less than 24h before: No refund

5.2. Booking modification:
- Free if requested more than 24h before the tour
- Subject to availability

5.3. No-show:
- No refund in case of no-show without prior notification

ARTICLE 6 - CANCELLATION BY PROVIDER
6.1. Marrakech Local Tours reserves the right to cancel a tour in case of:
- Dangerous weather conditions
- Insufficient number of participants (minimum 2 people)
- Exceptional circumstances (strikes, site closures, etc.)

6.2. In case of cancellation by the Provider:
- The Customer will be informed as soon as possible
- A full refund will be issued
- An alternative date will be offered if possible

ARTICLE 7 - TOUR OPERATION
7.1. Meeting point:
- Private tours start from your hotel in Marrakech
- The exact time will be confirmed the day before the tour

7.2. Duration:
- The indicated duration is approximate
- It may vary depending on traffic conditions and group preferences

7.3. Customer obligations:
- Be punctual at the meeting point
- Follow the guide's instructions
- Wear appropriate clothing and footwear
- Respect the sites visited and local culture

7.4. The Customer acknowledges that:
- Itineraries may be modified for safety or logistical reasons
- Published photos are representative but may differ slightly

ARTICLE 8 - LIABILITY
8.1. Provider's liability:
- Marrakech Local Tours commits to providing the described services
- Our liability is limited to the booking amount
- We are not responsible for customers' personal belongings

8.2. Insurance:
- Customers are advised to take out personal travel insurance
- Marrakech Local Tours does not cover medical or repatriation costs

8.3. Customer's liability:
- The Customer is responsible for their own safety and that of accompanying minors
- The Customer must inform the Provider of any relevant health issues

ARTICLE 9 - INTELLECTUAL PROPERTY
Photos and videos taken during tours may be used by Marrakech Local Tours for promotional purposes, unless the Customer expressly objects.

ARTICLE 10 - COMPLAINTS
10.1. Any complaint must be sent in writing to info@marrakechlocaltours.com within 7 days following the tour.

10.2. We commit to responding within 14 business days.

ARTICLE 11 - FORCE MAJEURE
Marrakech Local Tours cannot be held liable in case of force majeure, including: natural disasters, epidemics, strikes, government decisions.

ARTICLE 12 - DATA PROTECTION
Personal data is processed in accordance with our Privacy Policy and Moroccan Law 09-08.
